Motorists who have retrofitted their vehicle with aftermarket high-intensity discharge (HID) headlamps or xenon bulbs may find themselves in trouble if House Bill 3769 filed by Rep. Neri Javier Colmenares of the Bayan Muna party-list is passed into law.

Known as the Act Prohibiting the Use of High Intensity Discharge (HID) Headlamps, the bill filed by Colmenares claims that the excessive glare generated by HID or xenon headlamps inconveniences drivers and passengers of other vehicles.

"Many countries have prohibited or regulated the use of these headlamps precisely in response to the threat to road safety posed by its use," Colmenares said.

According to Colmenares, the bill seeks to address the problem posed by the use of non-standard headlights, "particularly bright and glaring white lights by vehicles that use HID or high intensity discharge headlamps."

"The use of these HID headlamps in vehicles, including refitting of tungsten-halogen headlamps to HID headlamps, is not in consonance with traffic safety standards," said Colmenares.

The solon added that the distraction caused by the glare may result in serious accidents that not only endangers other vehicles and motorists but pedestrians as well.

Under the bill, any person or entity selling motor vehicles equipped with glaring lamps shall be fined P100,000 for every sale of a vehicle fitted with the headlamp. Registered car owners and drivers of a motor vehicle installed with or using the prohibited HID headlamp shall each be fined with P10,000.

Since retrofitting HID headlamps is illegal in major car manufacturing markets like the United States and Germany, do you think it should also be declared as illegal in a small market like the Philippines?

    may tutunguhan kaya ang pag file niya ng bill? baka hangganag unang salvo lang.

    Maraming kotse dyan, na casa pa nagkakabit ng HID, pero talagang di tutulad sa original. Iba naman kasi talaga ang Headlamps ng for HID at for halogen.

    Siguro isama niyo na rin ang mga kotse na sobrang liwanag ng 3rd brake light, parang laser.

    aftermarket lang talaga dapat ang iban ng bill na ito, no harm on motorist ang original HID.

    Some vehicles here, planta pa nagkakabit ng aftermarket HID.

    dapat ipagbawal din ang sobrang dark tint.

    problema kasi magpapalagay ng dark tint tapos mag-papaHID kasi hirap makakita sa gabi. eh kung hindi kasi kayo nagpatint ng sobrang dilim edi hindi niyo kailangan mag HID in the first place. common sense lang.

    but then again common sense isnt very common.

    Our eyes take considerable time to adapt to the glare produced by non-projector HID lamps. It's like placing a bright flashlight in front of your eyes. I protest to such nuisance with a long horn blow. For the safety of everyone else using the road at night, PASS IT!

    EH KUNG YUNG SISTEMA KAYA MUNA NILA ANG AYUSIN BAGO i-ban ang HID. Wala pa akong nababalitaang namatay dahil sa HID lamps. So, wala silang rason. MAsakit kamo sa mata? Pumikit sila.

    take some time to read this : http://www.dft.gov.uk/pgr/roadsafety/drs/hidheadlampthe problem on the headlamp is not whether it projector or just the regular ones, the problem rises from the beam, both HID and halogen headlamps have different beam patterns. Last time, I saw the Vios limited , it seems fitted with aftermarket HID (it's factory installed, so you get nice brackets), unlike those of high end cars which are original (let's just say they're designed to be HID, so beam is perfect). Based on my observation, originals have their ballast underneath the headlamp itself, whereas the aftermarket are just bracketed somewhere in engine bay.

    first things first, HID ang problema bakit tint nadamay na rin ? Let's face it, mali mali talaga ang knowledge natin when it comes to these technologies. Kasi puro remedyo ang ginagawa, which ends up to poor local standards. Sino naman nagsabi na dapat projector type lang ang puwede mag HID? Ang problema yung beam pattern. Ipagtabi niyo dapat ang isang car na same model, isa fitted with Original HID at isa aftermarket to see ang difference. Para malaman na ang original HID hindi eye straining kahit katapat mo pa ang source ng light.

    Aminin niyo na kasi, yung mga nagpapalagay ng HID na nakakadugo ng mata ng ibang drivers, ginagawa yun mainly for porma. Sige wala pa ngang namamatay dahil dun, pero aantayin mo pa ba magkaron?

    imo, mahirap hulihin yang mga jeep at taxi na walang headlight, kase meron naman sila, pinapatay lang nila, hence, madali umabswelto kung sakali mang may batas na ganyan, although its considered a driving etiquette to turn on your headlights past 5:30pm.

    anyway, im all for this bill. its about time someone did something against abusive/undisciplined drivers. hirap satin pag may isang bill na napasa dami nag sasabing "isama nyo na rin to, unahin to, mas importante to" blah blah, hanggang wala nang natapos. isa isa lang.

    There are far more important issues concerning road safety that need to be addressed first before banning H.I.D. lamps. Like improving road illumination, filling in deep holes that are almost everywhere, removing those concrete barriers that account for many accidents. C'mon people, use your heads! Good luck with that Mr. Colmenares. You'll surely piss off a lot of people IF that bill gets passed.

    IF the bill passes, would the police/mmda be able to tell what an aftermarket hid is comapred to a regular one? i have a feeling that they might just make huli anyone with hid. even the ones with the hid that are okay would have to defend themselves for what? money in the pockets for the people who made them huli. what else is new? :/

    will have to wait out and see what happens to the bill.

    @Users of 3rd party HID,
    1. Remove/replace your st*p*d dark windshield tint.

    2. CLEAN you headlights. Blame yourself for poor maintenance of your HL. Dont make street lights an excuse.

    just as GBfive said, if you need HID to drive, you have to get your eyes checked.

    ang hihina naman ng mga mata niyo kung HID pa ang kailangan niyo para makakita.

    o baka naman sobrang dark kasi ng tint niyo? in that case, utak pala ang mahina sa inyo, walang common sense. magpapa dark tint tapos hirap na hirap makakita sa gabi.

    I've driven in rural areas of other countries where there are no streetlights and where the road condition is bad, and the locals don't use lamps brighter than halogens. So there's no difference between unlit PHL's streets and other countries', whether advanced or not.

    The only difference is that we choose to ignore safety by installing aftermarket HIDs to compensate for darkly tinted windshields!

    I agree with banning aftermarket HIDs. They really do hurt the eyes if you happen to come across one, high beam mode or not.

    As for those who say the some streets are poorly illuminated, that is true but should you then not slow down your pace a bit. The roads will certainly be dark if you are the only on the road, then you could simply turn on your high beams so you could see farther ahead. If you notice that there will be oncoming traffic, turn your high beams off.

    If that doesn't work, then you might have dirty headlights already or a very dark tint which obstructs your vision of your surroundings at night.

    It is true majority of our streets should be funded to have more lighting, but it isn't as pressing a matter as what our government needs to address as immediate. We should just drive more carefully if faced with poorly lit roads.

    And as for the concern with how the police will identify aftermarket with OEM HIDs, well I think simply adding it in the Car Registration Info should suffice as a tag with OEM HIDs as a notation that needs to be typed out.

    That should at least rid the concern of how you present the info, if questioned, if you HIDs are OEM or aftermarket, in which aftermarkets will impose fines or a ticket.

    It should more or less take about a year or two upon approval of the bill so the LTO has time to give owners, upon their renewal of vehicle registration, the updated documents of us owners having OEM HID or not.

    It also eliminates the need for newly registered vehicles for the year to go back to LTO just to have that added on or changed to their papers.

    The law should also provide a 30 day window for all owners with aftermarket HID lamps to have their refitted with the original halogen lamps.

    The law should also state that all cars before the year of introduction of OEM HID lamps are deemed illegal from having HID as it automatically and obviously places them in the catergory of aftermarket HIDs.

    sphynx, I agree with you, toggle on your high beam when you are the only person occupying the road, then switch off when there's an approaching car. That makes sense. Illegal HIDS must not be tolerated at all cause!

    There's still easy solution who insists on high beam, flash them or turn your high beam too, They will possibly feel they have to turn off their high beam. But of course, there are still those stubbon drivers who will ignore you even they know you were glared by there High beam.

    Well you can't really make it a law as it is a driving etiquette to turn off your high beam if there is oncoming traffic headed towards you, stock or otherwise.

    If you do make it a law, it just presents itself as an undefined situational law that we as motorists would have issues with against the authorities.

    Flashing your high beam towards the vehicle/driver who does not observe driving etiquette is the only proper recourse.

    The only recourse you can really do in case he/she does not lower his/her high beam is to slow down as your vision is really greatly impaired beyond the his headlights to ensure that you are not at least caught up in a tangle once you reach the artificially created blind spot in front of you.

    pag na-ban pati ang dark tint, lalaki ang % success rate of kotong lispu. :)) Makikita na nila kung bata pa yung driver.. Sana lang, yung ibang good cops, hindi na magaya sa bad ones.. I think hindi rin 'to uusad, may gumawa na rin ng ganitong bill from some solon of Cebu, hindi ko lang matandaan yung detalye..?

    I HOPE THIS WON'T BE PASSED! Paano nila matatanggal ang original HID??? They'll downgrade? Pathetic! That's part of the SRP of the car. Kotong lang mangyayari nyan! Let's say afttermarket lang ang huhulihin. Paano na yung may original HID? Paano pag nanghuli yung mga pulis ng may original HID?

    Basahin mo ng maayos. Ang planong ipa-ban is the aftermarket HID which are mostly installed improperly on cars that are equipped with HL that are designed for halogen or tungsten bulbs. This causes excessive glare to incoming motorists while not providing the optimal road illumination. My Camry is equipped with OEM HID, but only for low beam, the high beam is halogen, it doesn't cause glare to incoming motorists.

    how will they (MMDA, police, etc.) know if a car has an orig. HID? and hindi naman po kasi pare parehas ang ilaw ng mga sasakyan, lalo na ang may mga kalumaan na. basta para sakin the best solution would be the improvement of street lights, :) btw, may mga nabibili din po na snap on projector on crystal headlamps, pwede na din po ba ipalagay ang HID dun at hindi na siya glaring? :D

    It's pretty obvious, Aftermarket have too much glare, that improves the visibility but at the expense of an incoming motorist., while OEMs are made to be good for visibility and just nornal color temperature.

    The legislation in itself has merit as it is a safety concern with regards to use aftermarket HIDs.

    However, currently, the legislation proposed should be amended to pertain to aftermarket HIDs and not OEMs.

    The legislation should also put in place measures as to how we as consumers are not harassed in any way, shape, or form if our vehicle does have OEM and properly designed HID bulbs. (see my previous post in this comment section).

    I know the proposal I mentioned is not ironclad, but we can help make it a better law while it is still not yet passed/rejected can we not?

    But as I mentioned also in that post, I think the legislation can automatically dictate the "era" or year where vehicles model years predating year 2000 (or the exact introduction of OEM HID lamps) are automatically illegal (say a 1997 civic/corolla/lancer for example).

    It should put in place a window of opportunity upon implementation of the IRR for vehicles with aftermarket HIDs to refit them with their stock lamps/bulbs within 30 days (for those vehicles which are automatically placed under the "illegal" clause).

    However, we need the additional 2 year period, upon implementation of the said law for LTO to issue to addendum in the O.R. C.R. of your vehicle that states whether or not your vehicle comes with the OEMs. (this is simply a proposal because new vehicles bought on the implementation year of law would need 3 years before they need to reregister their vehicles.)

    Again, it's just my recommendation. I think it can be done.

    But we also need to just focus on that issue and not stray on other issues if you are to tackle that law. Just my 2 cents. =)

    install the HID but make sure that it will be adjusted in a way that it won't affect approaching vehicle..

    i just hope di ito matuloy.. ang gawan nila ng bill is yung mga jeepneys na di gumagamit ng headlights sa gabi o siguro dahil wala talaga sila ilaw..

    Dapat isama sa inspection sa lto and headlight metering para ma correct kung sino man ung wrongly installed headlight particularly ung mga jeeps, trucks and ung ibang car owners who doesnt care kung ok ung fixtures basta may ilaw lang. At sana every six months ang check up ng head lights. There is no need to ban HID.

    Dapat hanggang 35 watts hid lang at hanggang 6000k-8000k lang ang max na kulay.
    Dapat kapag magrrenew ng registration ang sasakyan, kasama sa inspection kung tama ba ang buga ng low beam at high beam, halogen man o hid. Meron mga halogen lang, mostly jeepneys, pero ang low beam nila nakakasilaw na tapos mag-bbrright pa sayo. Kung tama naman sa cut off line ang low beam, hid man o hindi, aftermarket man o oem, payagan nila. Dapat magkaroon sila ng magandang gamit pang-check ng alignment at dapat sibakin nila ang corrupt! (Pag nga pala nagkasibakan ng mga corrupt, baka wala pang 5% ng total employees ng government ang matira. Baka pati pangulo tanggal. haha).

    this is just a matter of correct light angles, kahit halogen kapag mali ang alignment, masakit din sa mata. look at oem HIDs, di naman masakit sa mata. it just boils down to road courtesy which many of us lack.

    This all matters on the angle of the light, just as art had said. Those of Audi and BMW don't really interfere with road safety and all of that. Aftermarket fitters of HIDs better do a good job fitting 'cause if they don't, they might be out of a job.
